Unlike many terms of service pages, this page is designed to be easy to read and understand. Our goal is to clarify what you can expect from SoftCafe when using our Menu App for Facebook, and what we'll expect from you.
So please read this entire page carefully, as using the MenuPro Menu App means accepting these terms. If you do not agree to these term, do not use the MenuPro Menu App. These terms may have changed since your last visit to this page and/or your last use of the App. By using the MenuPro Menu App you indicate acceptance of any updates to these terms and conditions.
The MenuPro Menu App, a service of SoftCafe, LLC, is provided to you at no charge. We expect this product and the services offered by this product will change over time. In particular, we will make feature changes and/or add advanced user options that may only be available for additional fees. Your right to use this product is limited in scope, revocable, personal, non-transferable and non-exclusive.
If you violate any of these terms your privileges to use the App will be terminated. We may immediately prevent access to all of your data used with the App, including content that you have published for public use on Facebook, without prior notice or liability to you.
To access the MenuPro Menu App you will be required to install the app through Facebook. SoftCafe does not sell, trade, or otherwise transfer to outside parties your registration data or any personally identifiable information, with the exception of when we believe the release is necessary to comply with the law. We may occasionally contact you via email with product updates that we feel will improve your experience with the Menu App. These emails will always include a prominent, and effective, unsubscribe link.
You are responsible for all content posted and activity that occurs under your account. This means that you need to ensure that all of the content posted on Facebook complies with all applicable laws and regulations, including (but not limited to) U.S. copyright law. SoftCafe does not prescreen content to ensure compliance, but we do have the right (but not the obligation) to refuse or remove any content that is available via the App, at our sole discretion.
You may not use the MenuPro Menu App to:
a) transmit any information, images, files, links, communication or other content that is, or which SoftCafe considers in its sole discretion to be, unlawful, harmful, threatening, abusive, harassing, defamatory, pornographic, hateful or threatening to any group defined by race, religion, gender, national origin or sexual orientation, or otherwise objectionable, including without limitation blatant expressions of bigotry, prejudice, racism, hatred or excessive profanity or post any obscene, lewd, excessively violent, harassing or otherwise objectionable content
b) impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity
c) make available any material that contains software viruses, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware equipment
d) interfere with or disrupt the service of Facebook or SoftCafe
We may or may not pre-screen data provided by users but we shall have the right (but not the obligation) to pre-screen, refuse, or move any data that is available via our products or Service.
You will receive access to our Menu App on either a free or fee basis, provided that there will not be any fee-based services initially. Our fee-based Services, when available, are expected to be a enhanced versions and features of our App, and these fee-based features will always be optional.
The MenuPr Menu App service is provided by SoftCafe on an "as is" and "as available" basis. We do not guarantee and are not liable for any failure to access or store your data on Facebook at any time.
Without limiting the foregoing, we make no warranty that:
The MenuPro Menu App service could include technical or other mistakes, inaccuracies, or typographical errors. We may make changes to the materials and services, at any time without notice. The service materials may be out of date, and we make no commitment to update such materials or services.The use of the MenuPro Menu App service, SoftCafe materials, or any other materials through this site is done at your own discretion and risk and you agree that you will be solely responsible for any damage to your computer system or loss of data that results from such activities.
Some states or jurisdictions do not allow the exclusion of certain warranties, so some of the above limitations may not apply to you.
This Agreement shall commence on the date you first install our Menu App or use the MenuPro Menu App service. Notwithstanding the foregoing, SoftCafe may stop, temporarily or permanently, providing the App, Services or any features within the App or Services, to You or users generally and may not be able to provide You with prior notice. We retain the right to create limits on access and expiry of our App and Services at our sole discretion at any time without prior notice.
The MenuPro Menu App service is controlled by us from our offices within the state of Maryland, United States of America. It can be accessed and used on Facebook from all 50 states, as well as from other countries around the world. As each of these places has laws that may differ from those of Maryland, by accessing the MenuPro Menu App you agree that all matters related to the use of the App shall be governed by the statutes and laws of the State of Maryland, without regard to the conflicts of laws principles thereof.
You also agree and hereby submit to the exclusive personal jurisdiction and venue any court of competent jurisdiction within the State of Maryland with respect to such matters.
These terms constitute the entire agreement between you and SoftCafe with respect to your access and use of the MenuPro Menu App, superseding any prior agreements between us (including any prior versions of these terms). The failure of SoftCafe to enforce or exercise any right or provision of these terms of service shall not constitute a waiver of that right or provision.
